NOTICE OF CONSENT JUDGMENT BETWEEN THE U.S. DEPARTMENT OF LABOR AND MISSISSIPPI STATE MEDICAL ASSOCIATION BENEFIT PLAN
BY ORDER OF THE U.S. DISTRICT COURT

ATTENTION:      PLAN PARTICIPANTS AND BENEFICIARIES OF THE MISSISSIPPI STATE MEDICAL ASSOCIATION                                                          BENEFIT PLAN; AND
 

                                 HEALTH CARE PROVIDERS PROVIDING OR WHO HAVE PROVIDED SERVICES TO PLAN PARTICIPANTS AND 
                                  BENEFICIARIES OF THE MISSISSIPPI STATE MEDICAL ASSOCIATION BENEFIT PLAN.

A CONSENT JUDGMENT BETWEEN THE U.S. DEPARTMENT OF LABOR AND THE MISSISSIPPI STATE MEDICAL ASSOCIATION BENEFIT PLAN HAS BEEN ENTERED BY THE U.S. DISTRICT COURT FOR THE SOUTHERN DISTRICT OF MISSISSIPPI.

 

YOU ARE RECEIVING THIS NOTICE BECAUSE YOU WERE A PARTICIPANT OR BENEFICIARY OF THE MISSISSIPPI STATE MEDICAL ASSOCIATION BENEFIT FUND OR YOU ARE A DOCTOR, HOSPITAL, OR OTHER MEDICAL PROVIDER WHO PROVIDED SERVICES TO A PARTICIPANT OR BENEFICIARY OF THE MISSISSIPPI STATE MEDICAL ASSOCIATION BENEFIT PLAN.

 

THIS NOTICE IS TO INFORM YOU OF THE CONSENT JUDGMENT AND CERTAIN PROVISIONS OF THE CONSENT JUDGMENT.

For Plan Participants and Beneficiaries: Under the Consent Judgment, the Court has appointed Receivership Management, Inc. as the Independent Fiduciary to carry out the provisions of the Consent Judgment. Receivership Management, Inc. has been directed to adjudicate and process claims for medical services that were not fully paid by the Mississippi State Medical Association Benefit Fund. The Mississippi State Medical Association, under the terms of the Consent Judgment, has been directed to pay funds needed to reimburse Plan Participants and Beneficiaries for any valid outstanding benefit claim.

 

Instructions regarding payment of outstanding benefit claims held by Participants and Beneficiaries:

1. If you responded to a questionnaire issued on July 28, 2006, Receivership Management, Inc. has your claim information.

2. If you did not respond to a questionnaire issued on July 28, 2006, PLEASE CONTACT OUR OFFICE AT 615-370-0051 WITHIN SIXTY (60) DAYS OF YOUR RECEIPT OF THIS NOTICE.

 

For Doctors, Hospitals, Therapists, Laboratories, and Other Health Care Providers: Under the Consent Judgment, the Court has appointed Receivership Management, Inc. as the Independent Fiduciary to carry out the provisions of the Consent Judgment. For additional details as to how this Consent Judgment applies to you, please refer to the Consent Judgment which can be viewed at www.receivermgmt.com/msma/consent.pdf.

 

SPECIAL NOTE TO DOCTORS, HOSPITALS, AND OTHER MEDICAL PROVIDERS—AN INJUNCTION IS IN PLACE: The Court included in its Order the following direction to providers of this plan:

 

                “All hospitals, physicians, pharmacists, therapists, laboratories, and other health care providers, including their agents, employees, representatives, and assigns are hereby enjoined from commencing or continuing any judicial, administrative, enforcement, or other proceeding, asserting any lien, providing negative reports to any credit rating or credit rating reporting entity, and threatening to take any such action against the Mississippi State Medical Association Plan or  any participant or beneficiary of the Mississippi State Medical Association Plan. This injunction is issued under authority of the All Writs Act, 28 U.S.C. 1651 (a), to prevent interference with this Consent Judgment and to ensure an orderly resolution of claims arising out of the Mississippi State Medical Association Plan’s termination with insufficient funds to pay claims for medical benefits.”
